Welcome to Foil Style. These Terms of Service ("Terms") govern your access to and use of the Foil Style website located at foilstyle.com (the "Site") and any products, services, or content offered through the Site (collectively, the "Services"). Please read these Terms carefully before using the Services.

By accessing or using the Services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, please do not use the Services. These Terms apply to all visitors, customers, and others who access the Site.

1. Changes to These Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Account Registration

Creating an account is optional — you may check out as a guest at any time. However, registering for an account unlocks additional features including order history, saved shipping addresses, and access to our loyalty rewards program. We encourage repeat customers to create an account for a faster, more personalized shopping experience.

If you choose to register for an account, you agree to:

• Provide accurate, current, and complete information during registration.

• Maintain and promptly update your account information, including your current shipping address.

• Keep your password confidential and not share it with any third party.

• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms.

3. Products and Orders

Product Descriptions and Sizing

We make every effort to accurately represent our apparel, including product images, descriptions, and materials. However, please be aware of the following:

• Colors: Fabric colors may appear differently depending on your screen settings, monitor calibration, and lighting conditions. We recommend reviewing product descriptions carefully and contacting us if you have questions about a specific color before ordering.

• Sizing: Fit can vary between styles and garment types. Where available, we provide size guidance on product pages to help you find the best fit. If you are unsure of your size or cannot find sizing information for a specific item, please contact us before placing your order and we will do our best to help.

• Materials: Fabric composition and care instructions are listed on each product page where available. We recommend reviewing these before purchase, particularly if you have sensitivities to specific materials.

We reserve the right to correct any errors in product descriptions, pricing, or availability at any time without prior notice.

Pricing

All prices are listed in US dollars and are subject to change without notice. Sale prices apply only during the promotional period indicated. We reserve the right to modify or discontinue any product at any time. We shall not be liable to you or any third party for any modification, price change, or discontinuation of a product.

Order Acceptance

Placing an order on our Site constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud. Your order is accepted when we send you an order confirmation email and process your payment. We are not responsible for pricing or typographical errors and reserve the right to cancel orders placed at an incorrect price.

Payment

All payments are processed securely through Shopify Payments and our authorized payment processors. By placing an order, you represent that you are authorized to use the payment method provided. We accept major credit and debit cards as displayed at checkout. Payment is due at the time of order.

Inventory and Availability

We sell apparel in limited quantities and certain styles, sizes, or colorways may sell out. Placing an item in your cart does not reserve it. In the rare event that an item you ordered becomes unavailable after your purchase, we will notify you promptly and issue a full refund to your original payment method.

4. Shipping

We currently ship to addresses within the United States only. Orders are processed Monday through Friday, excluding federal holidays, within 1–3 business days of receipt. During peak periods — including new collection launches, sales, and major holidays — processing times may extend to 3–5 business days.

We offer standard, expedited, and overnight shipping options. Shipping rates are calculated at checkout based on your location and order weight. Free standard shipping is available on all US orders of $100 or more (after discounts, before tax), applied automatically at checkout.

Delivery timeframes are estimates provided by the carrier and are not guaranteed. We are not responsible for delays caused by carriers, weather, or other circumstances outside our control. Once your order has shipped, you will receive a confirmation email with tracking information.

It is your responsibility to provide an accurate shipping address at checkout. We are not liable for orders delivered to an incorrect address provided by you. Please review our full Shipping Policy at foilstyle.com for complete details.

5. Returns, Exchanges, and Refunds

We want you to love what you ordered. We accept returns and exchanges on most items within 30 days of the delivery date, subject to the conditions below. Please review our full Return Policy at foilstyle.com for complete details.

Eligible Items

To be eligible for a return or exchange, items must be unworn, unwashed, in original condition with all tags attached, and free from odors, stains, or damage caused after receipt.

Non-Returnable Items

The following items are final sale and cannot be returned or exchanged:

• Items marked as Final Sale at the time of purchase.

• Intimates, bodysuits, and swimwear for hygiene reasons.

• Gift cards.

• Items that have been worn, washed, altered, or damaged after delivery.

Return Shipping

Customers are responsible for return shipping costs. We recommend using a trackable shipping method, as we cannot be responsible for items lost in transit back to us. Original shipping charges are non-refundable. Return shipping is covered by us only in the case of our error or a manufacturing defect.

Refunds and Exchanges

Once we receive and inspect your return, approved refunds will be issued to your original payment method within 5 business days. We offer free exchanges for a different size or color of the same item, subject to availability. To initiate a return or exchange, please contact us at hello@foilstyle.com with your order number.

Holiday Returns

Orders placed between November 15 and December 31 are eligible for an extended return window through January 31 of the following year, provided all other return conditions are met.

6. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, apparel designs, lookbook photography, and software — is the property of Foil Style or its content suppliers and is protected by applicable intellectual property laws. The Foil Style name, logo, and any original graphic designs featured on our apparel are trademarks and/or copyrights of Foil Style.

You may not reproduce, distribute, modify, display, publish, or create derivative works from any content on the Site, including copying our apparel designs, without our prior written consent. Personal, non-commercial use for the purpose of viewing and shopping is permitted.

7. User Content

We love hearing from our customers! Our Site may allow you to submit product reviews, style photos, comments, or other content ("User Content"). By submitting User Content — including photos of yourself wearing Foil Style apparel — you grant Foil Style a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, and display such content in connection with our Services and marketing across our website, email, and social media channels.

You represent and warrant that your User Content:

• Is accurate and not misleading.

• Does not infringe any third-party intellectual property, privacy, or other rights.

• Does not contain unlawful, defamatory, obscene, or offensive material.

• If it includes photos of individuals, that you have obtained their consent to share and license their likeness.

We reserve the right to remove any User Content at any time without notice if we believe it violates these Terms or is otherwise objectionable.

8. Prohibited Uses

You agree not to use the Site or Services to:

• Violate any applicable local, state, national, or international law or regulation.

• Engage in any fraudulent, deceptive, or misleading activity, including submitting false returns or chargebacks.

• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

• Purchase items for the purpose of unauthorized resale or commercial distribution without our written consent.

• Collect or harvest personal information about other users without their consent.

• Transmit spam, unsolicited communications, or any form of automated data collection (scraping, bots, crawlers) without our express written permission.

• Attempt to gain unauthorized access to any part of the Site, our servers, or any related systems.

• Interfere with or disrupt the integrity or performance of the Site or Services.

Violation of these prohibitions may result in immediate termination of your access to the Services and may be referred to appropriate legal authorities.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services, including our payment processors, shipping providers, and advertising platforms such as Meta, TikTok, and Google. These links are provided for your convenience only. We do not control, endorse, or assume any responsibility for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

10. Disclaimer of Warranties

The services and all content, products, and materials available through the site are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. FOIL STYLE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the site, including any sizing guidance or product descriptions.

11. Limitation of Liability

To the fullest extent permitted by applicable law, FOIL STYLE and its officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the services or these terms, even if advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to these terms or the services exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Foil Style and its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any User Content you submit.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Ohio, and you hereby consent to the personal jurisdiction of such courts.

14. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and governing law — shall survive.

15. Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any other policies referenced herein, constitute the entire agreement between you and Foil Style with respect to the Services and supersede all prior agreements, understandings, and representations. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
